Terms and Conditions

Thank you for choosing Smart Mobility. We are dedicated to delivering a high standard of service and reliable experience for all our customers. While every effort is made to ensure smooth operations, occasional unforeseen circumstances may arise. To ensure clarity and mutual understanding, we kindly invite you to review and familiarize yourself with the terms and conditions set out below.


General Rental Information

The renter must hold a valid European or International Driving License issued at least one (1) year prior to the rental start date. Vehicles will not be released without a valid European or International Driving License. At the time of vehicle collection, the principal driver and any additional drivers must present their original, full driving license issued in their own name.

Rental rates are calculated based on vehicle collection and return at the same rental location. Rental days are calculated on a 24-hour basis starting from the vehicle pick-up time. Vehicles must be returned no later than 60 minutes after the scheduled drop-off time. If the vehicle is returned more than 60 minutes late, an additional rental day will be charged at the applicable Walk-In Rate. Any charges for optional extras or additional equipment must be paid locally.

If the renter is not satisfied with the vehicle, the rental station must be notified immediately and no later than 30 minutes after vehicle pick-up in order to request a replacement at no charge. Requests for vehicle changes made after the 30-minute grace period will incur a fee of €50.00.

Partially used vouchers are non-refundable unless prior written confirmation has been provided by us. The car rental company will not provide services for any reservation that has not been confirmed.

All cancellations must be sent to customercare@smartmobilitymalta.com. A cancellation is only considered confirmed once you receive a reply from us confirming it. Amendments to readily confirmed bookings made less than 1 day prior to arrival are subject to availability and are not guaranteed. All amendment requests must be sent to customercare@smartmobilitymalta.com, and an amendment is only confirmed once you receive a written confirmation from us. Driver’s License Requirements

Drivers must hold a valid license for the category of vehicle they intend to rent. If a driver’s license is not written in the Roman alphabet (for example, Arabic, Greek, Cyrillic, or Chinese), the driver must present both the original domestic license and a valid International Driving Permit (IDP). For licenses issued by countries that do not participate in the International Driving Permit treaty, the driver must present the original license along with an official translation.

Age Restrictions

Eligible driver age: 21–25 years (Young Driver) and 71–75 years (Senior Driver).

Customers outside these age ranges are not eligible to rent a vehicle.

Additional Fees

Young Driver Fee (ages 21–25): €15.00 per day

Senior Driver Fee (ages 71–75): €15.00 per day



Conditions of Payment

The main driver is always required to hold a valid credit card in their own name, specifically a VISA or MasterCard credit card. Prepaid cards, virtual credit cards, debit cards (except when used to pay balances or reduce the deposit/excess), American Express, Diners Club, Bancoposta, and Revolut are not accepted. Cash payments are also not accepted. The renter must present their car rental voucher to the car rental company at the time of pickup. A deposit or pre-authorization is held on the credit card for 30 days and is automatically released by the bank after this period. The credit card must be valid for at least three months after the return date of the rental vehicle. If the renter fails to present a valid credit card, if there are insufficient funds available, or if the credit card is not in the main driver’s name, the car rental agent reserves the right to refuse to release the rental vehicle. In such cases, no reimbursement or refund will be made for any funds already paid.


Pre-Auth and Credit Card Declined Transactions.

Should your card be declined when a ticket is charged, the whole deposit will be taken as a completion. The balance will be returned to your card after 30 working days, in this case less €50.00 processing fee charges. 


Cancellation and No-Show Policy

Booking Cancellations - All cancellations must be made online or via email at customercare@smartmobilitymalta.com at least 48 hours before the scheduled booking.

Cancellations made less than 48 hours before the booking are non-refundable.

Amendments and Optional Extras

Changes to your booking or cancellation of optional extras may not be possible less than 24 hours before pick-up.


No-Show / Refusal at Pickup

If the rental is refused at pickup due to any of the following reasons:

  • Customer refuses to rent at pickup time
  • Customer refuses to provide the required deposit
  • Invalid or expired driving license
  • Renter under the influence of alcohol or drugs

A charge of €45.00 (Inc. VAT) will apply.


Taxes / Surcharges /Fee

Contract fees are already included in our offer. Services / Assistance and All extras’ charges are Including VAT. 


Fines, Parking Tickets, Penalties and Administration charges.

Fines, parking tickets, penalties, and administration charges are applied according to the type of contravention. The administration fee for any type of violation is €200.00 per contravention. All contraventions are charged directly to the credit or debit card provided by the client.


Vehicle Towed 

If your vehicle is towed by local enforcement due to negligent parking, a fee of €400.00 will be charged for us to collect the vehicle. This fee does not include any contraventions issued by local enforcement.




Controlled Vehicle Access (CVA)

A one-time fee of €10.00 shall be payable per contract to obtain Controlled Vehicle Access. Payment must be made at the Counter Desk prior to activation of the service.



Late Returns Policy

For vehicle drop-offs, a maximum grace period of 60 minutes is allowed. During peak season, the grace period must be approved by the rental company. Returns beyond the allowed time will incur an additional charge equivalent to 1 extra day’s rental at the walk-in rate, starting from €45.00 per day.


No Smoking in Vehicles

It is strictly forbidden to smoke in the vehicles, a smoking fee of €100.00 Vat included will be applied.


Refuse Vehicle

If the client refuses the vehicle for unknown reasons no refund will be given. 


No Show Policy

If the renter does not arrive within 60 minutes of the confirmed pick-up time and fails to notify the office via WhatsApp, telephone, SMS, or email of the delay, the car rental company reserves the right, at its sole discretion, to declare a ‘No Show’. In such cases, the company may refuse to provide a rental vehicle if the renter arrives at a later time.


Territorial Restriction 

Transportation between the Maltese islands is allowed.

In the case of recovery assistance or breakdown on the island of Gozo the fee is €200.00. This may be waived at the discretion of the rental company depending upon the cause of the breakdown.


Cross border

Travelling to Italy/Sicily is not permitted.


24 Hour Assistance.

In case of accident or breakdown of vehicles, client must contact our 24 hours Assistance at the following telephone number 0035699069225, and 0035699209209.

In case of any damage causing the breakdown of the vehicle, as per the articles 1561, 1562 and 1563 of the Civil Code, the Customer will be charged for the tow truck service fee of €200 VAT included or €250 incl VAT for cases in the Island of Gozo. 


If your vehicle is towed by local enforcement due to negligent parking, a fee of €400.00 will be charged for us to collect the vehicle. This fee does not include any contraventions issued by local enforcement.


Fuel policy

The car must be returned with the same amount of fuel as at the time of pickup. If it is returned with less, a refueling charge of €3.50 per liter will apply, along with a refueling administration fee of €50.00 (including VAT). Any unused fuel is non-refundable, and fuel costs at the rental desk are higher than at regular fuel stations. Fuel is not included in the rental rate and must be paid at the rental desk. Charges for incorrect refueling, such as using the wrong fuel type, will be applied according to the car category.


Oil and Maintenance

Any expenses for engine oil will be reimbursed upon delivery of regular receipt made out to the Lessor. No other type of expenses will be reimbursed without prior authorization from our desk staff.


Opening Hours 

The company is open from 08:00 am till 19:00pm. 


Out Of Hours – Drop Off of the Vehicle

Our office hours are from 08.00 am till 19:00 pm, out-of-office hours charge is €70.00 Including VAT.

Returns of the vehicle before the stipulated times indicated on your reservation that occurs before the opening time should be requested by emailing customercare@smartmobilitymalta.com and a confirmation from our department, without the confirmation this will not be accepted and the Abandon Vehicle Fee will be charged.


Abandoned Vehicle

If the renter fails to return the rental vehicle at the agreed time and location, the vehicle will be considered abandoned. In such cases, the renter agrees to pay an abandoned vehicle fee of €100, in addition to any costs for damages assessed according to the car rental company’s damage price list. The renter expressly authorizes the car rental company to charge these amounts to the deposit or to the credit card provided, either as a direct or delayed transaction, and consents to such charges without further notice.


Vehicle Check In and Check Out.

The Customer is required to carefully inspect the vehicle’s condition before leaving the parking area and must document it by taking clear photos or a video of the vehicle, including all sides, tires, and any existing damage. After signing the Rental Agreement and the Vehicle Inspection System and taking delivery of the vehicle, the Customer will be fully responsible for any damages not previously noted, and any complaints regarding unrecorded damages will not be accepted. Removal or tampering with any company stickers or logos on the vehicle is strictly prohibited, and a charge of €50.00 will apply for any such removal.. 


Condition of Vehicle

The vehicle must be returned in the same condition as received, allowing for normal wear and tear. If the renter is not satisfied with the car, the rental station must be notified immediately for a replacement within 30 minutes of pick-up; after 30 minutes, a €50 fee applies for vehicle changes. Lost, missing, or damaged keys will incur a fee based on the Damage Matrix price plus delivery costs. Excessive interior staining or damage will be charged according to the supplier’s valet rates. Renters are responsible for thoroughly inspecting the vehicle at pick-up and drop-off, and the company will take photos at both times to document its condition. Customers are not authorized to repair the vehicle.


Damages

Any damages discovered around the whole body of the vehicle not indicated/reported in the Vehicle Condition System (“Vehicle condition out”) when initially rented by the renter shall be considered as new damages and shall be charged from your credit card according to the Car rental company damage price list. The renter is hereby agreeing and accepting the damage price list set out by the Car rental company in case of damages incurred on the rental vehicle.

The renter expressly agrees and accepts that in the case of any damages incurred to the vehicle that is discovered upon the return of the vehicle to the Car Rental Company, the Car rental company may and has full authorization from the hirer to charge the credit card of the renter for any damages to the rental vehicle, and this in accordance with the prices specified in the damage price list. The renter is hereby giving his express consent and authorization to the Car rental company to carry out a charge either from the deposit or as a separate transaction / delayed charge transaction from the credit card provided in the case of any damages incurred and discovered on the rental vehicle. The renter is also hereby agreeing and accepting the charges indicated in the damage price list.

The Vehicle Condition System is for indication of Damages ONLY.


Lost, damaged, or stolen keys.

If a vehicle key is lost, damaged, or stolen, the car rental company will charge according to the Smart Mobility Damage Price List, with a minimum fee of €395.00 and a maximum of €800.00 (VAT included). An administration fee of €75.00 also applies, along with the cost of one day for repair and installation. All terms, conditions, and prices are subject to change.


Repair and Installation

A daily charge will be applied to the renter for repair and installation in cases where the vehicle requires repairs due to damages, accidents, or loss of keys occurring during the rental period. This charge applies if such events render the vehicle unusable for any period. The daily rate for the loss of use will depend on the vehicle’s group or category, as specified in the damage price list.


Accidents

In the event of an accident, the police or wardens must attend the scene. The renter must notify the rental company immediately and attend the rental company’s premises to complete all required documentation.

Any applicable excess and administration fees will be charged to the main driver’s credit card. The main driver remains fully responsible, even if the accident was caused by an additional driver.

Copies of all accident-related documentation will only be provided if signed by the renter.

The excess applies per accident. If the renter requires a replacement vehicle, a new pre-authorisation and/or deposit will be required.

If the driver is hospitalized, the accident must still be reported to the rental company, and a medical certificate must be provided as proof of hospitalization.

No insurance coverage applies to accidents caused by or resulting from the use of alcohol or drugs, or from transporting illegal materials.


General conditions – Waiver/reduced excess packages

  • Waiver/Reduced Excess Package Basics
  • The package is valid for only one incident. Even if purchased, certain coverages are not included. A deposit or pre-authorization will still be taken from the renter’s credit card to cover any uninsured parts of the vehicle, traffic fines, or administration fees.
  • Coverage Not Included in CDW/FDW
  • Damage to the undercarriage, roof, glass, mirrors, tires, wheels, alloys, or hub caps is not covered. Items stolen from the rental vehicle are not insured. Fire damage and personal accidents are excluded. Accidents that occur while the driver is under the influence of alcohol or drugs, or while transporting illegal materials, are not covered.
  • Additional Services (depending on the package purchased)
  • Included services may consist of 24-hour breakdown service (excluding negligence, flat battery, or punctures), real-time emergency phone assistance, replacement car in case of breakdown, unlimited kilometers, collision damage waiver (with excess applicable), third-party liability coverage up to €2,000,000, and clutch damage is included in the coverage.
  • Accident Reporting Requirements
  • A police report is required for any accident involving third parties or considerable damage to the vehicle. A claim form must be completed at the rental office. If the driver is hospitalized, a medical certificate must be provided. Accidents caused by alcohol, drugs, or the transportation of illegal materials are not covered.


Items Not Covered under the Renters Conditions if no counter Packages are purchased.

Without additional protection packages, the following are not covered: mechanical repairs or issues with the engine, gearbox, clutch, or oil pan not approved by the provider; interior cleaning or damage; damage or loss of child seats, GPS, or other equipment; lost or stolen keys and documents; stolen vehicles if the key is lost or not presented; and lockout charges. Administrative fees, fines, tolls, parking charges, personal belongings stolen from the vehicle, loss of use charges, and roadside assistance due to renter fault are also excluded. Damages from careless, negligent, or dangerous driving, driving off-road or in unauthorized areas, refueling errors, or breach of the rental agreement—including driving under the influence—are not covered. Damage to tires, rims, alloys, glass, mirrors,glass, interior, the undercarriage, and missing fuel is likewise excluded


Plain Language Summary

The waiver reduces financial responsibility for certain damages but many risks are excluded, such as theft, undercarriage damage, fire, and personal accidents. Clutch damage is included. Major accidents, particularly involving third parties, must be reported for coverage. Administrative costs, fines, and damages caused by reckless or illegal behavior are never covered. Optional services like breakdown assistance may be available depending on the package purchased.


Purchasing the Reduce Excess Packages

There is a deposit still to be taken when purchasing the Reduce Excess packages. Administration fees are not included. Negligence is not included.


If no police report is presented the Package will become Null. The price of the package starts from €25.00 daily depending on the Category of the vehicle.

Complaints

All complaints must be submitted to our offices within 7 days of the completion of the rental agreement. Complaints should be sent only to the following email address: customercare@smartmobilitymalta.com. Emails sent to any other address will not be reviewed.

After the 7-day period, we reserve the right to disregard any complaints.


Court and Jurisdiction

For any dispute arising out of this contract, the parties agree such disputes shall be referred exclusively to the competent Authorities, Tribunals, or Courts of Malta; or, if agreed between the parties the arbitration proceedings as contemplated by the Arbitration Act (Chapter 387 of the Laws of Malta). The rental agreement is governed by the Maltese law, and therefore such law is to be applied to any dispute arising therefrom.


Data Protection

The renter agrees and accepts that by signing this agreement he/she has given consent to the Car Rental Company to collect and use his/her personal data. Personal data means information by which an individual may be identified, directly or indirectly, and includes among other things, the renter’s name, surname, identification number, residential address, email, mobile number, and banking/ credit card details. Such personal data will only be used for the restricted purpose of registering the renter and for managing the business relationship thereafter. Under the Data Protection Law (General Data Protection Regulation, GDPR EU Regulation 2016/679), personal data may only be processed for lawful purposes. The Parties agree that the third-party Car rental company will process the renter’s personal data to a) enter into/perform the contract; b) comply with the requirements of the law c) to serve the legitimate interests of either party. The renter agrees and consents to the transfer of his/her personal data to third parties for the same purposes as defined in this clause. Such third parties include any relevant government entities, and inland revenue departments together with legal advisors, accountants, and auditors. Personal data collected will only be kept as long as necessary and for as long as legally required for record and accounting purposes. All personal data will be destroyed after such times.  For information and other rights regarding personal data kindly make reference to: the General Data Protection Regulation, GDPR EU Regulation 2016/679.

Recording or filming of our staff is strictly prohibited. Any violation will result in immediate cancellation of the client’s rental, and all payments will be forfeited. Harassment, discriminatory, or offensive behavior toward staff will not be tolerated and may result in legal action.”


Acknowledgment, Acceptance, and Authorization

The Hirer/Renter hereby acknowledges that they have carefully read, fully understood, and voluntarily accepted all terms and conditions governing this Rental Agreement. By executing this Agreement, the Hirer/Renter expressly agrees to be bound by all terms and conditions of the Car Rental Company, including any supplemental or ancillary documents executed at the time of vehicle rental.

The Hirer/Renter further authorizes and consents to the Car Rental Company charging the Hirer/Renter’s credit card for all fees, charges, costs, and amounts due and payable in accordance with this Agreement and any related documentation.
