Thank you for choosing Smart Mobility. We wish to provide our customers with the best service possible. Although problems are rare, unfortunately, they sometimes are unavoidable and may occur. Therefore, to avoid any misunderstandings do take some time to read and understand our terms and conditions below:
General Rental Information
The renter must hold a valid European or International Driving License, issued not less than one year before the date of rental. The rental car will not be provided to renters without a valid European or International Driving License. When collecting the vehicle from our Rental Desk the principal driver and any additional drivers shall need to provide a full driving license in their name.
Rates are calculated based on collection/return to the same rental location. Rental days are calculated on a 24-hour basis from the car pick-up time. Rental cars must be returned no later than 60 minutes from the specified drop-off time. If the return of the rental car is delayed for over 60 minutes from drop off time, the renter will be charged an additional day’s rate at the price of the Walk-in Rate. Any additional charge for extra equipment shall be paid locally.
In case the renter is not satisfied with the car, the station needs to be informed immediately of its replacement within 30 minutes of the time of the rental/check out of the vehicle. If a customer would like to change the vehicle after the 30-minute grace time, there is a charge €50.
Partially used vouchers are not refundable unless the renter has received our previous confirmation. Services from the car rental company shall not be provided for any unconfirmed reservation/s.
Age Restrictions Driver’s age:
21 to 25 (young driver) and 71 to 75 (senior driver) Customers who fall outside the age limitations will not be able to rent.
Driver’s license:
Drivers must hold the correct category for the vehicle they wish to rent. If your driver’s license is not in the Roman alphabet (i.e., if it is in Arabic, Greek, Cyrillic or Chinese) you are required to bring an International Driving Permit and your domestic license. For driving licenses from countries not part of the international driving license treaty, an official translation of the license must be presented with the original license.
Contact
All cancellations must be sent to customercare@smartmobilitymalta.com and a confirmation email of such cancellation will be sent to you directly in reply. Amendments with regards to readily confirmed bookings made less than 1 day before arrival shall be subject to confirmation and are not guaranteed. All amendments requested must be sent to customercare@smartmobilitymalta.com and a confirmation must be received in reply to confirm such amendment.

Conditions of Payment
The main driver is always required to hold a valid credit card (VISA or MASTERCARD) in his name. We do not accept American Express, Diners Club, prepaid cards, virtual credit cards, cards without the number showing, or e-money cards (ex. Revolut). Debit cards will only be accepted for deposits when paying to reduce the deposit/excess or for paying balances. The renter must hold his car rental voucher and provide it to the Car rental company at the pickup time. The deposit/pre-authorization is held on the credit card for 30 days and is automatically released by the bank. If you fail to present a valid credit card; or there is a lack of sufficient funds available on the credit card provided, or the credit card is not held in the main driver's name, the car rental agent reserves the right to refuse to release the rental vehicle. In such instances, there shall be no reimbursement/refund for funds already paid by the renter.
The credit card must be valid for at least 3 months after the return date of the rental vehicle.
Accepted credit cards: VISA CREDIT, MASTERCARD CREDIT for deposit/pre-auth.
We do not accept PRE-PAID CARDS, Debit Cards, American Express, Diners Club, Virtual Credit Cards, Bancoposta and Revolut.
CASH PAYMENTS ARE NOT ACCEPTED.
Cancellation and No-show policy
All cancellations should be made online or by email at customercare@smartmobilitymalta.com not later than 48 hours before the actual booking. No refunds shall be issued if the booking is cancelled less than 48 hours before.
Amending your booking or cancelling optional extras may not be possible less than 24 hours before picking up.
Cancellations Policy
Cancellations at the pickup due to refusal of Customer to rent at pickup time refusal to hand in deposit, non-valid driving license, renter under the influence of alcohol, etc., will be charged with the amount of €45.00 Inc. VAT
NO-SHOW policy:
A 'no-show' occurs for the following reasons:
The car hire company reserves the right to refuse to provide a rental car if you fail to arrive on time with all necessary documentation and a credit card with enough available funds for the car's security deposit.
General Conditions Waiver/reduced excess package.
The waiver/reduced excess package is valid for only 1 incident.
The following coverage is NOT INCLUDED in the CDW/FDW
Please note that the renter shall NOT be covered by any Insurance/ Waiver cover in the case of accidents whilst renter/driver is under the influence of alcohol, drugs or involved in the transportation of any illegal materials/substances.
Included in our Offer depending on which Reduced excess package is purchased over the counter.
Reduced or Full Damage Waiver purchased with Smart Mobility.
Over-the-counter packages.
In the case of purchase of reduced or full damage waiver, a deposit/pre-authorization shall still be taken from the renters’ credit card. Such deposit/ pre-authorization in the case of reduced or full damage waiver, shall be held only in relation to any uninsured parts/aspects of the vehicle, traffic fines and indicated administration fees that may occur or be incurred during the rental periods.
The second driver Waiver/reduced excess package shall apply with an extra cost of €8.00 per day Incl VAT. The maximum number of additional drivers allowed per rental is (2) two per rental. The same conditions shall apply as per the main driver.
It is important to note, that specifically in the event of:
- Any accidents involving third parties or third-party property vehicles.
- Considerable damage/vandalism incurred to the vehicle.
The renter shall be required to file a police report to be covered by insurance/packages purchased at the desk. In the event that the renter chooses not to file such police report in such instances, the renter will not be covered by the insurance/waiver. In all cases, a Claim form must be completed at the office.
In the case that the driver is hospitalized then the accident is to be reported as soon as possible to the Car Rental Company, and proof (medical certificate) that the driver was in hospital is to be presented.
The renter is not covered by any Insurance cover for accidents caused by or as a result of alcohol, drugs, or transportation of illegal materials.
Items not covered by ANY CDW
• Repairs/Mechanical not approved by the car hire service provider.
• Cleaning Charges or damages to the interior of the car.
• Damages to/loss of child seats, GPS devices or other extra equipment.
• Damage to engine, gearbox, oil pan.
• Lost/Stolen/Broken car keys or car documents.
• Stolen Vehicle if key is not presented.
• Charges directly related to locking oneself out of the Rental Car.
• Any Administrative costs or Administration Fees listed in this agreement/damage price list.
• Instances where personal belongings are stolen from the interior
• When any Fraudulent, dishonest or/and criminal act has been committed by the driver or/ and passengers
• Loss of use charges (for potential loss of revenue that the car hire company suffered while car was being repaired and was not able to be hired out)
• Roadside Assistance charges (customer fault)
• Costs incurred under circumstances and as a result of a breach these General Terms and Conditions (such as, but not limited to : dangerous, careless or negligent driving, driving that breaches the local regulations, a vehicle being driven in unauthorized area/countries or unpaved roads, refueling errors, vehicle being stolen due to the loss of keys and/or documents, commercial use, driving under the influence of drugs or alcohol, etc.) or the terms of the hirer’s car rental agreement with the Car rental company/provider.
Not included in any damage waiver
In the case that the driver is hospitalized then the accident is to be reported to the Car Rental Company, and proof (medical certificate) that the driver was in hospital is to be presented.
The renter is not covered by any Insurance cover for accidents caused by or as a result of alcohol, drugs or transportation of illegal materials
Administration Fees
Administration fees will be applied in all of the following cases and are non-negotiable:

V.A.T. (18%) is already included in the Rental price. Municipality Taxes are already included in our offer. Premium Location Fee is a one-time charge of €25.00 incl VAT per contract and payable at the rental desk. Contract fees are already included in our offer. Services / Assistance and All extras’ charges are Including VAT.
Fines, Parking Tickets, Penalties and Administration charges.
The administration fee for contraventions without points is €60.00, contraventions that incur penalty points transfers have an administration fee of €90.00.
The administration fee for CVA is €35.00, these take around 3-4 months to be charged from the credit card.
Out of Hours – Collection of Vehicle.
Our office hours are from 08.00 am till 07:00 pm, and the out-of-office hours charge is €40.00 Including VAT.
From 01:00 am and 05:00 am the Out of Office Fee is €50.00 including VAT.
In case of “Out of Office Hours” reservations, the Customer is obliged to forward his mobile number and flight details. Clients who have paid for a FULL damage waiver (Platinum) may make use of the key drop box upon return and will not be charged the out-of-office hours fee for this service.
Out Of Hours – Drop Off of the Vehicle
Our office hours are from 08.00 am till 07:00 pm, out-of-office hours charge is €40.00 Including VAT.
Returns of the vehicle before the stipulated times indicated on your reservation that occurs before the opening time should be requested by emailing customercare@smartmobilitymalta.com and a confirmation from our department, without the confirmation this will not be accepted and the Abandon Vehicle Fee will be charged.
Purchasing the Reduce Excess Packages
There is a deposit still to be taken when purchasing the Reduce Excess packages. Administration fees are not included. Negligence is not included.
If no police report is presented the Package will become Null. The price of the package starts from €20.00 daily depending on the Category of the vehicle.

Late returns
For vehicle drop off, a maximum tolerance grace period is 60 minutes, after which there will be a charge of 1 extra day rental at the walk-in rate starting from €45.00 per day.
No Smoking in Vehicles
It is strictly forbidden to smoke in the vehicles, a smoking fee of €100.00 Vat included will be applied.
Pets on Board
No pets are allowed in rented vehicles, except for guide dogs. The penalty for pets without authorization is €150.00.
Refuse Vehicle.
If the client refuses the vehicle for unknown reasons no refund will be given.
No Show
If the renter does not appear within 60 minutes after the confirmed pick-up time and does not inform the office via WhatsApp, telephone, SMS or email of such expected delays, the car rental company has the right and sole discretion to declare a ‘No Show’ and not provide any rental car in case of the renter showing up at a later time.
Territorial Restriction
Transportation between the Maltese islands is allowed.
In the case of recovery assistance or breakdown on the island of Gozo the fee is €300.00. This may be waived at the discretion of the rental company depending upon the cause of the breakdown.
Cross border
Travelling to Italy/Sicily is not permitted.
24 Hour Assistance. (Calls only)
In case of accident or breakdown of vehicles, client must contact our 24 hours Assistance at the following telephone number 0035699069225, and 0035699209209.
In case of any damage causing the breakdown of the vehicle, as per the articles 1561, 1562 and 1563 of the Civil Code, the Customer will be charged for the tow truck service fee of €150.00 VAT included or €300 incl VAT for cases in the Island of Gozo.
Fuel Policy
The car shall be returned with the same amount of fuel with which it had at the pickup time, otherwise, a refueling charge shall be applied. The rate for missing fuel shall be that of €3.50 per liter. There shall also be applied a refueling administration fee of €35.00 Incl VAT. Any unused fuel is not refundable. Fuel cost per liter is higher at the rental desk. Fuel is not included in the rates and is payable at the rental desk. Wrong refueling charges shall be applicable according to the car category.
Oil and Maintenance
Any expenses for engine oil will be reimbursed upon delivery of regular receipt made out to the Lessor. No other type of expenses will be reimbursed without prior authorization from our desk staff.
Condition of Vehicle
Vehicle must be returned, in the same condition as received when rented (usual wear and tear expected). In case the renter is not satisfied with the car, the station needs to be informed immediately of its replacement within 30 minutes of the time of the rental/check out of the
vehicle. If the customer would like to change the vehicle after 30 minutes there is a charge €50.00. Lost/Missing/Damaged Keys fee applies in the amount of the price of the Damage Matrix, and the cost of the delivery. Excessive staining or internal damage will be charged for at the supplier’s valet rates. It is renter’s responsibility to check the vehicle thoroughly at pick-up/collection and drop-off. The car rental company shall take photos at pick-up and drop-off to ascertain the condition of the vehicle throughout the rental period. The Customer is not authorized to repair the vehicle.
Vehicle Check In/Out Form
The Customer is obliged to carefully check the condition of the vehicle before leaving the parking area. After signing the contract and Vehicle Condition Form and after the delivery of the vehicle, the client will be deemed solely responsible for any damages not noted. Any Complaint arising from such matter will not be accepted. If the company sticker/logo is removed from the vehicle this will be charged. The charge for the removal of stickers is €50.00.
Other options & Fees.
Please note that charges made at the location for any extras and applicable fees will be subject to any applicable taxes and location taxes /fees. You agree and accept that you are and shall be responsible at all times for the cost of any parking fines/ Valletta CVA charges and other penalties incurred whilst the vehicle is contracted to you. The rental agent will pass the relevant charges on to you plus any administrative expenses.
Lost, damaged, or stolen keys.
The car rental company will charge if the key(s) are lost according to the Smart Mobility Damage price list minimum charge starting from €395.00 (VAT included) to a maximum of €800.00 (VAT included.) Admin fee of €75.00.
The charge of (1) day loss of use will apply in such cases.
All terms, conditions, and prices are subject to change.
Repair and Installation.
A daily charge to the renter for the repair and installation shall be charged in the case of any repairs required due to damages/accidents to the vehicle and/or loss of keys occurring within the rental period which renders the vehicle unable to be used for a period. Such loss of use charge shall be applied at a daily rate and shall depend on car groups/categories as indicated in the damage price list.
Damages
Any damages discovered around the whole body of the vehicle not indicated/reported on the Vehicle Condition Report Form (“Vehicle
condition out”) when initially rented by the renter shall be considered as new damages and shall be charged from your credit card according to the Car rental company damage price list. The renter is hereby agreeing and accepting the damage price list set out by the Car rental company in case of damages incurred on the rental vehicle.
The renter expressly agrees and accepts that in the case of any damages incurred to the vehicle that is discovered upon the return of the vehicle to the Car Rental Company, the Car rental company may and has full authorization from the hirer to charge the credit card of the renter for any damages to the rental vehicle, and this in accordance with the prices specified in the damage price list. The renter is hereby giving his express consent and authorization to the Car rental company to carry out a charge either from the deposit or as a separate transaction / delayed charge transaction from the credit card provided in the case of any damages incurred and discovered on the rental vehicle. The renter is also hereby agreeing and accepting the charges indicated in the damage price list.
The vehicle condition form is for indication of Damages ONLY.
Pre-Auth and Credit Card Declined Transactions.
Should your card be declined when a ticket is charged, the whole deposit will be taken as a completion. The balance will be returned to your card after 30 working days, in this case less €50.00 processing fee charges.
Abandoned Vehicle
In the case of the renter abandoning the rental vehicle (not returning the rental vehicle at drop-off time and location), the renter is hereby granting authorization, agreeing, and accepting that he will be charged the “abandoned vehicle fee” €100 together with any damages discovered on the rental vehicles from his credit card, and these in accordance with the Car rental company’s damage price list. The renter is hereby giving his express consent to the Car rental company to carry out a charge either from the deposit or as a separate transaction / delayed charge transaction from the credit card provided in such cases.
Accidents
In the case of an accident involving third parties or third-party property and the rental vehicle, the renter acknowledges, accepts, and grants authorization that the excess/deposit held by the car rental company shall be charged in full of his/her credit card.
If the renter is found NOT to be at fault for the accident, the excess shall be refunded to the renter, however, the renter shall be charged an applicable damage handling administration fee of €75.00 (inclusive of VAT), and 10% Bank charges will be charged.
For clarification purposes, in the case that the renter has purchased a reduced or full damage waiver, in the case of accidents which are found to be the renter’s fault as specified above, damages and vandalism the rates and excess/deposit for the relevant waiver shall be applicable.
In the case that the driver is hospitalized then the accident is to be reported to the Car Rental Company, and proof (medical certificate) that the driver was in hospital is to be presented.
The renter is not covered by any Insurance cover for accidents caused by or as a result of alcohol, drugs or transportation of illegal materials.
Complaints
Any complaints must be received by our Offices within 7 days after the completion of the rental agreement. All complaints are to be sent to this email address customercare@smartmobilitymalta.com only. If any other email is used these will not be seen too.
Court and Jurisdiction
For any dispute arising out of this contract, the parties agree such disputes shall be referred exclusively to the competent Authorities, Tribunals, or Courts of Malta; or, if agreed between the parties the arbitration proceedings as contemplated by the Arbitration Act (Chapter 387 of the Laws of Malta). The rental agreement is governed by the Maltese law, and therefore such law is to be applied to any dispute arising therefrom.
Data Protection
The renter agrees and accepts that by signing this agreement he/she has given consent to the Car Rental Company to collect and use his/her personal data. Personal data means information by which an individual may be identified, directly or indirectly, and includes among other things, the renter’s name, surname, identification number, residential address, email, mobile number, and banking/ credit card details. Such personal data will only be used for the restricted purpose of registering the renter and for managing the business relationship thereafter. Under the Data Protection Law (General Data Protection Regulation, GDPR EU Regulation 2016/679), personal data may only be processed for lawful purposes. The Parties agree that the third-party Car rental company will process the renter’s personal data to a) enter into/perform the contract; b) comply with the requirements of the law c) to serve the legitimate interests of either party. The renter agrees and consents to the transfer of his/her personal data to third parties for the same purposes as defined in this clause. Such third parties include any relevant government entities, inland revenue departments together with legal advisors, accountants, and auditors. Personal data collected will only be kept as long as necessary and for as long as legally required for record and accounting purposes. All personal data will be destroyed after such times. For information and other rights regarding personal data kindly make reference to: General Data Protection Regulation, GDPR EU Regulation 2016/679.
Recording or filming of our staff is strictly prohibited and will result in the client’s rental being cancelled and payment forfeited.
The Hirer/Renter hereby acknowledges having read and understood all the terms and conditions related to this rental agreement and confirms that he/she accepts them all. The Hirer/Renter’s signature below hereby confirms this acceptance of all terms and conditions of the Car rental Company including the separate documents signed upon rental of vehicle. Such signatures constitute hirer’s acknowledgement, acceptance, and authorization for the Car rental company to charge the hirer’s credit card the amounts specified and due in accordance with such documentation.
